Move The Chains

Move The Chains terms of service

Last updated: [PUBLISH DATE]

Draft, not yet in force. This document still has 5 unresolved placeholders and has not been reviewed by a lawyer. It is published for transparency while the game is pre-launch, and it does not take effect until the placeholders are filled and the date above is set.

> > > > These terms are an agreement between you and [LEGAL ENTITY] ("Move The Chains," "MTC," "we," "us") covering the Move The Chains website, email list, and game (together, the "Service"). By creating an account or playing, you agree to them. If you do not agree, do not use the Service.

The short version

Move The Chains is a free season-long NFL fantasy game. There is no entry fee, there are no prizes, and there is no money involved anywhere. It is a game you play for the standings and for the argument.

The rest of this document is the careful version of that sentence.

Eligibility

You must be at least 13 years old to create an account.

If you are between 13 and 18 (or the age of majority where you live), you may only use the Service with the involvement and consent of a parent or legal guardian, and that parent or guardian agrees to these terms on your behalf and is responsible for your use of the Service.

The Service is not directed to children under 13 and we do not knowingly collect personal information from them. If we learn that we have, we will delete the account and the information. See privacy policy.

You are responsible for making sure your use of the Service is lawful where you are. We may restrict access from any jurisdiction at any time.

No entry fee, no prizes, no wagering

This matters enough to say plainly:

  • Move The Chains is free to play. We do not charge entry fees and we do not take payments.
  • There are no cash prizes and no prizes of value. Winning Season 1 gets you the top of the leaderboard and nothing else.
  • Nothing on Move The Chains is a wager, a contest of chance, or a paid fantasy sports contest. We do not operate a paid fantasy sports service and we do not accept deposits.

If we ever introduce anything that changes this, it will be announced before it takes effect and these terms will be updated.

Your account

  • One account and one entry per person. This is the core game rule, not fine print. Move The Chains is a single global leaderboard with one entry per manager, and multiple accounts controlled by one person distort the standings for everyone. It is the most direct way to be removed from the game.
  • Accurate information. You agree to provide accurate and complete information when you register and to keep it current.
  • You are responsible for your account. Sign-in uses a magic link sent to your email, so anyone with access to your inbox can access your account. Keep it secure, and tell us promptly at [CONTACT EMAIL] if you believe someone has used your account without your authorization. You are responsible for activity that occurs under your account.
  • Your handle is public. It appears on the leaderboard and anywhere else standings are shown. Do not use a handle that impersonates someone, infringes a trademark, or is abusive. We may reclaim or change handles that do.
  • We may need to reach you. Some email is operational rather than promotional: sign-in links, deadline reminders, and notices about your account. You can unsubscribe from newsletter content without losing those.
  • You can delete your account at any time. See privacy policy for what happens to your data.

Your licence to use the Service

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted.

You may not:

  • Create or control more than one account, or arrange for someone else to enter on your behalf.
  • Use bots, scripts, scrapers, or automated tools to draft, set lineups, make moves, or extract data from the Service.
  • Copy, reproduce, republish, or redistribute any part of the Service beyond ordinary personal use.
  • Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent that restriction is unenforceable under applicable law.
  • Interfere with scoring, the weekly batch, other managers' accounts, or the availability or integrity of the Service.
  • Probe, scan, or test the security of the Service, or breach or circumvent any security or authentication measure, without our prior written permission.
  • Exploit a bug rather than reporting it. If you find one, the in-app "report a problem" link is the fastest route, and we would rather hear about it than find it in the standings.
  • Use the Service to send spam, to harass anyone, or for any unlawful purpose.
  • Remove or obscure any proprietary notice on the Service.

We may suspend or remove any account, and adjust or void any score, where we reasonably believe these rules have been broken. Because there is no money involved, the consequence is removal from the game rather than anything more.

The game rules, and how they change

The game's mechanics — scoring, the salary cap, moves, audibles, deadlines, tiebreakers — are published and we intend to keep them stable within a season. But:

  • We may correct scores. Player statistics come from third-party feeds and the NFL revises box scores after the fact. We re-ingest stat corrections and re-run scoring, so your score and your rank can change after you first see them. This is normal and not a malfunction.
  • We may fix bugs mid-season, including bugs that were working in someone's favour.
  • We may change the rules between seasons, and, if something is genuinely broken, during one. Material in-season changes will be announced.
  • Deadlines are enforced by the server. What your browser shows is advisory. If your device clock, your connection, or a stale page disagrees with our record, our record governs.
  • We may change, suspend, or discontinue any part of the Service, including the Service as a whole.

Your content and feedback

You keep ownership of what you submit — your handle, support messages, feedback, and anything else you send. You grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, and display it for the purpose of operating and improving the Service, including displaying your handle in standings and quoting feedback in recaps. If you would rather we did not quote you, say so and we will not.

If you send us feedback, suggestions, or ideas, you agree we may use them without restriction and without any obligation to compensate or credit you. You represent that you have the rights to everything you submit and that it does not infringe anyone else's rights or violate any law.

Our content

The Move The Chains name, logo, site design, written content, and software are ours or our licensors', and are protected by intellectual property laws. Nothing in these terms transfers any ownership to you.

NFL team names, player names, logos, and statistics are the property of their respective owners. Move The Chains is not affiliated with, endorsed by, or sponsored by the National Football League, any NFL team, the NFL Players Association, or any player.

Third-party services and other managers

The Service depends on third parties for hosting, email, analytics, and statistical data, and may link to third-party sites. We do not control those services, we are not responsible for them, and their terms and privacy practices govern your use of them. Their failures can become our outages. How third parties handle your information is described in privacy policy.

Your interactions with other managers are between you and them. We are not responsible for the conduct of any user of the Service, though we may act on it under "Your licence to use the Service" above.

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless [LEGAL ENTITY] and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of the Service; (b) your breach of these terms; (c) anything you submit to the Service; or (d) your violation of any law or of any third party's rights.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

Availability and disclaimers

Move The Chains is operated by one person. Treat the support response times accordingly.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or available at any particular moment, including at kickoff; that any defect will be corrected; or that data, scores, standings, or statistics presented through the Service will be accurate, complete, or current.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, lost opportunities, or loss of goodwill, arising out of or relating to the Service, whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.
  • Our total aggregate liability for all claims relating to the Service is limited to the greater of one hundred U.S. dollars ($100) or the amount you have paid us in the twelve months before the claim, which is zero, because the Service is free.

These limitations apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

Term and termination

These terms apply for as long as you use the Service.

You may stop playing and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these terms, if we reasonably believe your use creates risk or legal exposure, or if we discontinue the Service.

If your account is removed mid-season, your entry is removed from the standings with it.

Sections that by their nature should survive termination do survive it, including "Your content and feedback", "Our content", "Indemnification", "Availability and disclaimers", "Limitation of liability", and "Governing law and venue".

State-specific notices

The provisions in this section apply only to the extent you are subject to the laws of the state identified. Where a provision here conflicts with another provision of these terms, the state-specific provision controls for users subject to that state's laws.

California. Under California Civil Code §1789.3, California users are entitled to the following notice: the provider of the Service is [LEGAL ENTITY], [BUSINESS MAILING ADDRESS]. To file a complaint regarding the Service or to receive further information about using it, write to that address or contact [CONTACT EMAIL]. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210. California residents may have additional rights under the California Consumer Privacy Act, as amended, including rights to know, delete, and correct personal information and to opt out of its sale or sharing. See privacy policy.

Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws. You may have additional rights, including rights of access, correction, deletion, and portability, and the right to opt out of targeted advertising, the sale of personal data, and certain profiling. See privacy policy for how to exercise them. We do not sell or share personal information as those terms are defined under these laws.

Changes to these terms

We may update these terms. When we do, we will change the "last updated" date above and, for material changes, give you at least 30 days' notice by email or in-product before they take effect, unless a change must take effect sooner to comply with law. Continuing to use the Service after the change takes effect means you accept the new version. If you do not agree, stop using the Service and delete your account.

Governing law and venue

These terms are governed by the laws of [GOVERNING STATE], without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in [GOVERNING STATE], and both parties consent to the personal jurisdiction of those courts.

There is no arbitration clause and no class-action waiver in these terms, which is a deliberate choice for a free game with no prizes. Nothing here prevents either party from seeking relief in small claims court where the claim qualifies.

If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings locally, nothing in this section removes that right.

General

  • Severability. If any provision of these terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest of these terms remain in force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these terms or your account. We may assign these terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Entire agreement. These terms, together with privacy policy, are the entire agreement between you and us about the Service and supersede any prior agreements on that subject.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including outages at our hosting, email, or data providers.
  • No third-party beneficiaries. These terms do not give rights to anyone other than you and us.
  • Headings are for convenience only and do not affect interpretation.
